Order Summary

FinCEN's permanent nationwide residential real estate reporting rule took effect March 1, 2026, replacing all Geographic Targeting Orders (GTOs). It was vacated on March 19, 2026 by the U.S. District Court for the Eastern District of Texas in Flowers Title Companies v. Bessent, and FinCEN and DOJ appealed that decision in May 2026. Reporting is therefore not currently required: reporting persons are not required to file real estate reports with FinCEN and are not subject to liability if they fail to do so while the vacatur remains in force. All prior residential real estate GTOs remain superseded.
